Throughout these Terms, “Sew Petal,” “we,” “us,” and “our” refer to Sew Petal. “You” and “your” refer to any visitor, customer, or person using our website or services.

By visiting our website, placing an order, submitting personalization details, or otherwise using our services, you agree to these Terms of Service. If you do not agree with these Terms, please do not use our website or purchase our products.

1. Eligibility

By using our website, you confirm that you are at least the age of majority in your place of residence or that you are using the website with the permission and supervision of a parent or legal guardian.

You may not use our products or services for any unlawful or unauthorized purpose.

2. Online Store Terms

You agree not to:

  • Use our website for fraudulent, illegal, or abusive activities
  • Attempt to gain unauthorized access to our website or systems
  • Introduce viruses, malware, or harmful code

3. Products and Services

Sew Petal offers custom embroidered, personalized, made-to-order, and non-personalized products.

We make reasonable efforts to display product descriptions, colors, sizes, materials, and images accurately. However, colors and details may appear differently depending on screen settings, lighting, garment texture, fabric color, thread availability, and the embroidery process.

Minor variations in thread color, embroidery placement, sizing, texture, or appearance are a natural part of personalized embroidery and are not necessarily considered defects.

We reserve the right to:

  • Modify or discontinue products without notice
  • Limit product quantities
  • Refuse or cancel an order when reasonably necessary
  • Restrict sales to certain locations or customers
  • Correct product information, pricing, or availability errors

4. Custom and Personalized Orders

Customers are responsible for reviewing all personalization information before submitting an order, including:

  • Names and initials
  • Dates and numbers
  • Spelling and punctuation
  • Uploaded photographs
  • Garment size and color
  • Thread and design selections
  • Placement instructions
  • Other customization details

Sew Petal is not responsible for errors contained in information submitted or approved by the customer.

Personalized products may not be eligible for return, exchange, or refund unless they arrive damaged, defective, incorrect, or significantly different from the approved design.

5. Customer Images and Design Content

When you upload a photograph, illustration, logo, text, or other content, you confirm that:

  • You own the content or have permission to use it
  • The content does not infringe any copyright, trademark, privacy, publicity, or other rights
  • You have permission from any recognizable person shown in the content
  • The content is not unlawful, harmful, hateful, defamatory, obscene, or misleading

You grant Sew Petal a limited, non-exclusive license to use, reproduce, resize, crop, convert, digitize, and otherwise process the submitted content only as reasonably necessary to prepare your design, manufacture your order, provide customer support, and resolve order-related issues.

We will not use customer-submitted photographs for advertising or promotional purposes without separate permission.

We may reject or cancel designs that we reasonably believe are illegal, harmful, abusive, infringing, or unsuitable for production.

6. Design Proofs

Some personalized orders may include a digital design proof before production.

When a proof is provided, you are responsible for reviewing:

  • Spelling and wording
  • Image selection
  • Layout and placement
  • Design details
  • Thread colors
  • Other visible customization elements

Production may begin after you approve the proof. Once approved, changes may no longer be possible.

Approval confirms that you accept the design shown. Sew Petal is not responsible for customer-approved errors unless the finished product differs significantly from the approved proof.

Delays in approving a proof may extend the estimated production and delivery time.

7. Orders and Order Acceptance

Submitting an order does not automatically guarantee acceptance.

We may decline, limit, or cancel an order due to:

  • Product or material unavailability
  • Pricing or listing errors
  • Suspected fraud or unauthorized payment
  • Incomplete personalization information
  • Infringing or prohibited content
  • Shipping restrictions
  • Technical or operational issues

If we cancel an order after payment has been processed, we will refund the canceled amount to the original payment method.

We may contact you using the email address or telephone number provided at checkout to verify information or request additional details.

8. Order Changes and Cancellations

Requests to change or cancel an order should be submitted within 2 hours of purchase by emailing support@sewpetal.com.

We will make reasonable efforts to accommodate your request, but changes and cancellations are not guaranteed.

Once design preparation, digitization, material ordering, or production has started, a personalized order may no longer be changed or canceled.

9. Prices and Payment

Prices are displayed in the currency shown on our website and may change without notice.

The price charged will be the price displayed at checkout when the order is submitted, except where a clear pricing or technical error has occurred.

You agree to provide current, complete, and accurate billing and payment information.

By submitting payment information, you confirm that you are authorized to use the selected payment method.

Applicable taxes, shipping charges, duties, or other fees will be displayed at checkout when available or assessed according to applicable law.

10. Promotions and Discount Codes

Promotions and discount codes may:

  • Be limited to certain products or customers
  • Have expiration dates
  • Require minimum purchase amounts
  • Be restricted to one use per customer or order
  • Be unavailable for previous purchases
  • Be subject to additional conditions

Unless otherwise stated, promotions cannot be combined. We may modify or end a promotion where permitted by law.

11. Shipping and Delivery

Production and delivery estimates are provided for convenience and are not guaranteed delivery dates.

Delivery may be affected by:

  • Design-proof approval times
  • Production volume
  • Carrier delays
  • Severe weather
  • Holidays
  • Customs processing
  • Incorrect addresses
  • Events outside our reasonable control

Customers are responsible for entering a complete and accurate shipping address.

12. Returns and Refunds

Returns, replacements, exchanges, and refunds are governed by our Return and Refund Policy.

Because personalized products are created specifically for the customer, they are generally final sale unless damaged, defective, incorrect, or significantly different from the approved design.

Nothing in these Terms limits any mandatory consumer rights that apply under local law.

13. Intellectual Property

All website content owned by or licensed to Sew Petal—including text, graphics, logos, photographs, designs, product presentations, videos, icons, and website layout—is protected by applicable intellectual-property laws.

You may use our website only for personal, non-commercial shopping purposes.

You may not copy, reproduce, distribute, modify, publish, sell, license, scrape, or commercially exploit our content without prior written permission.

“Sew Petal” and related branding may not be used in a way that suggests sponsorship, affiliation, or endorsement without our written approval.

14. Reviews and Other Submissions

You may submit reviews, comments, photographs, suggestions, or other feedback.

You agree that your submission will:

  • Reflect your genuine experience
  • Not contain false or misleading statements
  • Not infringe another person’s rights
  • Not contain unlawful, threatening, hateful, or abusive material
  • Not contain malicious code or commercial spam

Unless you request otherwise in writing, submitting a public review or promotional photograph grants Sew Petal a non-exclusive, worldwide, royalty-free license to display, reproduce, format, and share that submission for customer-service, website, and marketing purposes.

This promotional license does not automatically apply to private photographs uploaded solely for product personalization.

We may remove or decline to publish submissions that violate these Terms.

15. Privacy

Your submission of personal information through our website is governed by our Privacy Policy.

16. Third-Party Services and Links

Where liability cannot be excluded, Sew Petal’s total liability relating to an order will not exceed the amount paid for the product or service giving rise to the claim, except where applicable law requires otherwise.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

To the extent permitted by law, you agree to indemnify and hold Sew Petal harmless from claims, damages, liabilities, and reasonable expenses arising from:

Obligations and liabilities incurred before termination will continue where applicable.

The remaining provisions will continue in effect.
